The Foggia Court acquitted officials of the Municipalities of Rocchetta (Mastropietro Angelantonio) and Biccari (Luisi Fedele) with full formula from the accusation of having issued illegitimate measures in order to favor Fortore Energia entrepreneurs Antonio Salandra and Michele Ferringo (also defendants) in the construction of a wind farm in Capitanata.
The investigation was born from the complaint, supported by Lipu, of an entrepreneur (Tilli Donato) who was unable to obtain any authorization for the creation of similar installations.
The Electricity Service Operator had also filed a civil action in the proceedings.
The Lawyer. Michele Vaira, defender of Fortore and of the two municipal leaders, says: “The Court understood that the action of the complainants was the mere – and desperate – attempt to transform the criminal trial into the third degree of administrative judgment, which until then he had fully justified Fortore Energia at all locations, on a precautionary and merit basis. My clients have created jobs, produced clean energy, in compliance with all the (complex) regulations of the sector, even collecting 32 authorizations for each individual installation. Municipal officials have obtained, in the interest of their respective populations, the highest royalties in the whole national territory, and in exchange have undergone continuous administrative and judicial stalking. We have also waited patiently for this procedural junction, without ever reacting to the constant provocations, now an intense phase of reparations begins for those who, in recent years, have systematically defamed and slandered my clients »
